Terms of Service

Effective date: July 5, 2024 · Last updated: May 24, 2026

These Terms of Service govern your access to and use of AM Learning, an online education platform operated by Heuristics of Science and Technology. By creating an account or using any part of the service you agree to be bound by these terms.

1

Acceptance of Terms

By accessing or using AM Learning (the "Platform", "Service", or "Application") you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference.

If you are using the Service on behalf of an organisation, institution, or other legal entity, you represent that you have the authority to bind that entity to these terms. In that case, "you" also refers to that entity.

If you do not agree to these terms, you must not access or use the Service.

2

Eligibility

You must be at least 18 years of age to create an account or use the Service. If you are between 13 and 17 years old, you may only use the Service under the supervision of a parent or legal guardian who agrees to these terms on your behalf. We do not knowingly provide the Service to children under 13.

By using the Service, you represent and warrant that you meet the eligibility requirements above and that all information you provide is accurate and complete.

3

Account Registration & Security

You may register for an account using an email address and password, or by signing in with a supported third-party provider ("Google Sign-In"). When registering via email you will be required to verify your email address before accessing all platform features.

You agree to:

  • Provide accurate, current, and complete registration information.
  • Maintain the security and confidentiality of your login credentials.
  • Not share your account with any third party.
  • Notify us immediately at sierra.amlearning@gmail.com if you suspect unauthorised access to your account.
  • Accept responsibility for all activity that occurs under your account.

We reserve the right to suspend or terminate accounts that contain inaccurate information or that we believe have been compromised.

4

Types of Accounts

AM Learning offers three primary account types, each with specific rights and obligations:

Student Accounts

Students may browse the course catalogue, enrol in and purchase courses, track learning progress, participate in quizzes and forums, post reviews, and manage their profile and wallet.

Teacher / Instructor Accounts

Teachers who have been verified by the platform may create, publish, and sell courses; upload videos, PDFs, and written content; build quizzes; host live classes; and receive payouts through the platform wallet. Teachers must apply for verification and agree to additional instructor obligations set out in Section 8.

Institution Accounts

Institutions (schools, universities, training centres, and similar organisations) may manage a branded subdomain, oversee affiliated teachers and courses, communicate with subscribers via a newsletter, manage events, run donation campaigns, and access institutional analytics. Institution administrators are subject to additional terms in Section 9.

5

Course Purchases & Enrolment

Some courses on AM Learning are offered free of charge, while others require payment. Prices are displayed on each course detail page and are quoted in the applicable currency.

  • Payment may be made using your platform wallet balance or a supported payment method.
  • Upon successful payment you receive a non-exclusive, non-transferable licence to access the purchased course content for personal, non-commercial learning purposes.
  • Purchased course access does not expire unless the course is removed by the instructor or the platform, or your account is terminated.
  • Free-preview content is available to unenrolled users as designated by the instructor.
  • You may not share, redistribute, re-sell, or publicly display paid course content.

6

Wallet & Payouts

AM Learning provides an in-platform wallet for students, teachers, and institutions. The wallet may be used to purchase courses, receive refunds, and (for instructors and institutions) to receive revenue from course sales.

  • Wallet funds are denominated in the currency specified in your account settings.
  • Students may top up their wallet using supported payment methods.
  • Teachers and institutions receive their share of course revenue into their wallet after the platform deducts applicable fees, which are displayed on the pricing page.
  • Withdrawals from the wallet are subject to the minimum withdrawal threshold and processing times shown in the wallet dashboard.
  • We reserve the right to hold, suspend, or withhold payout of wallet funds pending investigation of suspected fraudulent or policy-violating activity.
  • Wallet funds have no cash value outside the platform and may not be transferred between accounts unless explicitly permitted.

7

Refund Policy

We want you to be satisfied with your purchase. If you are not satisfied with a course you may request a refund under the following conditions:

  • Refund requests must be submitted within 14 days of the original purchase date.
  • You must not have completed more than 20% of the course content.
  • Courses explicitly marked as non-refundable are not eligible.
  • Approved refunds are credited to your platform wallet within 5–10 business days.
  • Abuse of the refund policy (e.g. repeated purchase and refund of the same course) may result in suspension of refund privileges or account termination.

To request a refund, contact us at sierra.amlearning@gmail.com with your order details.

8

Teacher & Instructor Terms

To become a teacher on AM Learning you must submit a verification application. We reserve the right to approve or deny applications at our sole discretion. Once approved, teachers agree to the following:

  • You are solely responsible for the accuracy, quality, and legality of all content you create and publish on the platform.
  • You must own or have obtained all necessary rights, licences, and permissions for any content you upload, including videos, images, audio, and text.
  • You grant AM Learning a worldwide, non-exclusive, royalty-free licence to host, display, distribute, and promote your course content to enrolled students and in platform marketing materials.
  • You may set your own course prices, subject to the platform's minimum and maximum price guidelines.
  • You must keep your course content up to date and accurate.
  • You may not use the platform to promote external services, products, or competing platforms without prior written approval.
  • Platform fees and revenue split percentages applicable to your account are shown in the Pricing section and your teacher dashboard.
  • We reserve the right to remove or delist courses that violate these terms or our content standards.

9

Institution Account Terms

Institutions granted access to institutional features agree to the following additional terms:

  • The institution administrator is responsible for all activity carried out by teachers and staff affiliated with the institution account.
  • Institutions may send newsletters to subscribers who have opted in to receive communications from that institution. Newsletters must comply with applicable anti-spam laws and must include a working unsubscribe link.
  • Institutions may host events, manage donations, and publish blogs, all of which must comply with these Terms and applicable law.
  • Institution branding (logos, names, and subdomains) must not infringe the intellectual property rights of any third party.
  • Misuse of institutional features, including sending unsolicited communications, may result in immediate suspension of the institution account.

10

You agree not to use the Service to:

  • Violate any applicable local, national, or international law or regulation.
  • Upload, transmit, or distribute malware, viruses, or any harmful code.

  • Live sessions may be recorded. By participating in a live session you consent to being recorded.
  • Recordings may be made available to enrolled students for review after the session.
  • Instructors are responsible for the content of their live sessions and must comply with all content standards in Section 11.
  • AM Learning is not responsible for technical interruptions to live sessions caused by factors outside our control.
  • Students who engage in disruptive behaviour during live sessions may be removed by the instructor.

13

Intellectual Property

The AM Learning platform, including its design, code, brand assets, and platform-generated content, is owned by Heuristics of Science and Technology and is protected by copyright, trademark, and other intellectual property laws.

User-generated content (course materials, quiz questions, forum posts, etc.) remains the property of the respective creator, subject to the licence granted to us as described in Section 8.

You may not use AM Learning's name, logo, or branding in any manner without prior written permission, except as permitted by applicable law.

We will never sell your email address to third parties. See our Privacy Policy for full details of how we handle your data.

AM Learning facilitates donation campaigns for institutions and causes listed on the platform. By making a donation you acknowledge the following:

  • Donations are voluntary and generally non-refundable unless a specific campaign explicitly states otherwise.
  • AM Learning is not responsible for the use of donated funds by the recipient institution or organisation.
  • Donation campaigns must comply with applicable fundraising and charity laws.
  • We may apply a platform processing fee to donation transactions, which will be clearly disclosed before you confirm a donation.

16

Third-Party Services

The Service integrates with third-party services including but not limited to Google (for authentication) and payment processors. Your use of these third-party services is subject to their respective terms of service and privacy policies.

When you sign in using Google Sign-In, Google will share limited profile information (such as your name and email address) with us in accordance with Google's OAuth policy and Google's Privacy Policy.

We are not responsible for the practices of any third-party services linked to or from our platform. Links to external websites do not constitute endorsement.

17

Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or usefulness of any course content or information on the platform.

Some jurisdictions do not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

18

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HEURISTICS OF SCIENCE AND TECHNOLOGY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD 100).

Some jurisdictions do not allow limitations on liability for certain types of damages, so some of the above limitations may not apply to you.

19

Indemnification

You agree to indemnify, defend, and hold harmless Heuristics of Science and Technology, its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of or access to the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content you submit, post, or transmit through the Service.

20

Termination

We may suspend or terminate your account and access to the Service immediately and without prior notice if we believe you have violated these Terms, engaged in fraudulent or harmful activity, or if required by law.

You may delete your account at any time from your profile settings or by contacting us. Upon account deletion, your access to purchased courses will end. Wallet balances remaining at the time of voluntary account closure may be refunded at our discretion, subject to applicable fees.

Provisions that by their nature should survive termination (including intellectual property ownership, disclaimers, indemnification, and limitations of liability) shall survive.

21

Changes to These Terms

We may update these Terms from time to time. For material changes we will provide at least 30 days' notice by posting the new Terms on this page and, where appropriate, sending an email to registered users. The updated date at the top of this page will always reflect the most recent revision.

Your continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms. If you do not agree to the new Terms, you must stop using the Service.
